Job Description

The Assistant General Counsel - Litigation/Environmental position will reports to the Deputy General Counsel - Litigation & IP. It will manage and oversee various types of litigation, including but not limited to PFAS, toxic tort, product liability, environmental remediation, and other chemical exposure litigation matters.Manage outside counsel to secure favorable results and reduce outside counsel spend.Provides supervision to litigation paralegal(s).Coordinate communication with insurance carriers on PFAS, toxic tort, product liability, environmental remediation, and other chemical exposure litigation matters.Prepare position statements for federal, state and local government agencies, and attend fact-finding and settlement conferences.Assist with Crisis Management and advising on EPA's RMP and OSHA's PSM matters. The position will have some U.S. Travel Expected (Approx. 10%).

Essential Duties & Responsibilities

Litigation Matters (80%):

Defend Company, manage outside counsel, and budget matters in PFAS, toxic tort, products liability, chemical exposure, and environmental remediation litigation:

  • Advise the company's senior management, businesses, and other managers byproviding advice on assessing risks and values of claims (and potential claims) and advising on strategic dispute resolution. If claim is filed: hiring and managing outside counsel, positioning the Company for a strong defense, assist with securing insurance coverage, strategizing on offers to compromise, and taking a matter to trial.
  • Substantive litigation areas handled directly by this position include personal injury matters (PFAS, chemical exposure, toxic torts); environmental remediation litigation (CERCLA and RCRA, and other federal and state environmental statutes) and insurance coverage disputes. Litigation includes claims by individuals, corporate and governmental entities, by and against Arkema, Inc.
  • Other substantive litigation areas handled directly by this position include health and safety matters (such as OSHA matters) including the preparation of position statements for federal, state and local government agencies, attending fact-finding and settlement conferences, and representing the company during safety related government investigations.

Health, Safety and Environmental Matters (20%):

  • Provide advice to the company concerning safety, health and environmental related compliance.
  • Provides legal advice and has significant interaction with senior business unit leaders, including Management Committee members, Manufacturing Directors, General Managers, Business Managers, Plant Managers, and plant and corporate HES and HR.
  • Provides consistent and efficient handling of CERCLA and RCRA Corrective Action environmental litigation, and toxic tort and products liability litigation.
  • Assist with Crisis Management and advising on EPA's RMP and OSHA's PSM matters
  • Manages various types of litigation involving health, environmental and safety matters
  • Minimizes the need for outside legal resources and expenses by providing high quality, cost effective litigation legal services.
  • Supports the site HES policy and complies with all regulatory and internal requirements
  • Participates in HES activities provided by site management and Arkema Inc.
  • Supports and promotes the reporting of all health, safety, environmental, near-miss, accident or injury incidents

Minimum Qualifications and Education Requirements

  • A minimum of fifteen (15) years' of related experience, including PFAS litigation/environmentalremediation, as well as experience as lead trial attorney
  • J.D. from U.S. law school and admission to Pennsylvania Bar.

Competencies - Knowledge Skills & Abilities

This position operates as an adviser to senior management and must independently work and prioritize simultaneously with multiple litigation matters and other responsibilities.

  • Prefer experience managing one or more of the following types of toxic tort litigation: PFAS, chemical exposures, and product liability, and ability to become quickly experienced in similar lawsuits (such as asbestos)
  • Experience with mass torts, multi-district litigation, environmental remediation litigation, health and safety litigation also a plus
  • Prefer experience in providing advice concerning health and/or safety related legal issues and compliance.
  • Experience in evaluating and managing litigation budgets.
  • Possesses general litigation experience, including experience related to trials, depositions, document and e-discovery, motions, and other litigation-oriented skills.
  • Ability to interact effectively with all levels of the organization.
  • Ability to communicate clearly and persuasively both orally and in writing
  • Ability to analyze and work with moderately complicated financial and statistical data.
  • Strong organizational skills, with an enthusiasm for diving into the details of the cases (facts, status and governing law).
  • Strong communication skills, including, writing and oral presentation skills.
  • Demonstrated ability to establish and maintain strong interpersonal relationships.
  • Ability to work as a member of a team with technical and business personnel.
  • Demonstrates creativity to ensure that Company business objectives are maintained, and requires management skills to select, retain and supervise outside counsel.

  • Hybrid schedule - 3 days in the office
